RE: The tariff classification of a “Jack Poster” from China

Dear Mr. Zhao:

In your letter dated February 25, 2001 you requested a tariff classification ruling.

As indicated by the submitted information, the “Jack Poster” is an adjustable unit for the support of flooring and other heavy objects. It consists of two sets of tubing with threaded shafts, collars, and stamped plates for top and bottom support. You also inquire as to the classification of spare parts, specifically, a package containing a collar, shaft, two stamped plates and two steel pins, and a collar and shaft only.

The applicable subheading for the “Jack Poster” will be 7308.40.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for equipment for scaffolding, shuttering, propping, or pit propping. The rate of duty will be 1.7 percent ad valorem. The applicable subheading for the spare parts will be 7308.90.9590, HTS, which provides for structures and parts of structures, …, of iron or steel: Other: Other: Other. The rate of duty will be 1.7 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
